Auction Terms & Conditions Auction Terms & Conditions: This is an online only real estate auction. 10% Non Refundable earnest money in the form of certified check, cash or wire transfer to the closing atttorney's office, Shafer Law Office in Waukon, within 24 hours of completion of the auction, with balance due at closing around February 15, 2022, or as soon as paperwork can be completed. Possession would be given at closing. This property does sell "Subject to Approval" meaning the auction company will obtain Seller's Confirmation if they are willing to accept the high bid established at the close of the auction. If the seller does accept the bid, the successful bidder will be required to enter into a purchase agreement prepared by the closing attorney immediately following the close of the auction. This auction is not contingent upon financing, meaning the successful bidder will have 10% ready to be delivered to the closing attorney's trust account via certified check, cash, or wire transfer with 24 hours of the auction closing and will have the balance ready to go at closing. This sale is not subject to appraisal or inspection, property is being sold AS IS. This is a timed event and will begin to close at 1:00 PM CST. An auto extend feature is in place, so if someone bids in the final 5 minutes of the auction, it will extend another minutes. If a bid for this auction is placed at 12:59 PM, the auction will extend out until 1:04 PM. This will continue until there are no further bids received in the final 5 minute time frame. The Seller will provide a continuation of the abstract at their expense, which will be sent to the buyers attorney to perform the title opinion. The cost of the title opinion is an expense of the buyer. Seller will convey the property by Deed at closing and Real Estate Taxes will be pro-rated. Additional Information: *Well Information: 2008, The depth is 100' and it was done by Larson Well Drilling. *The old well on the back lot, parcel #2, was not capped from the information we have received. If you plan to do any type of construction on that lot, the well will have to be capped and you should check in with the Allamakee County Environmental Health Office for the process with that. *The description for parcel #2 said building potential may be limited due to utility easements and bluffland setbacks. When the auction opened, there was a 50' right-of-way easement with Allamakee-Clayton Electric Cooperative, Inc. That easement has since been reduced to 25' and the updated easement was recorded on 12/22/2021. Buyers will also have to take into consideration the Bluffland setbacks and any plans for construction would need to be discussed and approved by the Allamakee County Zoning Administrator and Environmental Health, if a septic is being considered. *Property is being sold AS IS by Estate, no property disclosure statements or time of transfer inspection on septic will be done.
